CIRCULAR

ON ARCHITECTURE DESIGN DOSSIERS AND SAMPLE OF ARCHITECTURE PRACTICE CERTIFICATE

Pursuant to Law on Architecture dated June 13, 2019;

Pursuant to Decree No.81/2017/ND-CP dated July 17, 2017 of the Government on functions, tasks, powers, and organizational structure of the Ministry of Construction;

At request of Director General of Planning - Architecture Department;

Minister of Construction promulgates Circular on architecture design dossiers and sample of architecture practice certificate

Chapter I

GENERAL PROVISIONS

Article 1. Scope and regulated entities

This Circular prescribes contents of architecture design dossier and sample of architecture practice certificate applicable to domestic and foreign organizations and individuals related to architectural design practice in territory of Socialist Republic of Vietnam.

Article 2. General regulations on architecture design dossier

1. Architecture design dossier is a part of construction design dossiers which shall be appraised and approved according to Construction Law.

2. Architecture design dossier consists of following types:

a) Preliminary architecture design dossier refers to architectural details in preliminary design during pre-feasibility study stage;

b) Basic architecture design dossier refers to architectural details in basic design during feasibility study stage;

c) Technical architecture design refers to architectural details in technical design during post-basic design stage;

d) Construction architecture design drawing refers to architectural details in construction drawings in post-basic design stage;

dd) Architecture design  dossiers in other design stages (if any) according to international practice correspond to construction design stages decided by persons deciding to invest when they decide to invest in the projects.

3. Architecture design dossiers in investment projects for specific constructions shall comply with Construction Law.

4. Architecture design dossiers in urban and rural planning schemes and urban design shall comply with Construction Law and Law on Urban Planning.

5. When revising architecture design, prepare revised architecture design dossiers consisting of revised drawings that include all following requirements:

a) Revised contents, date of revision and time of revision must be specified and consensus of design managers and project developers is required;

b) Designing organizations and project developers must countersign and be legally responsible for revision in name section of the drawings.

Chapter II

CONTENTS OF ARCHITECTURE DESIGN DOSSIERS

Article 3. Specification of architecture design dossier

1. An architecture design dossier consists of drawings and explanation.

2. Architecture design dossiers must satisfy following requirements:

a) Specification and sale of drawings must conform to National Standards TCVN 5671:2012 on construction design document – architecture design dossier system;

b) Name section of drawings must conform to National Standards TCVN 5571:2012 on construction design document – construction drawings – name section system.

3. Individuals being responsible for architecture affairs of organizations, legal representatives or authorized persons must sign and provide stamps of design contractors as per the law.

4. Design managers whose name is specified in design dossiers must:

a) Directly organize implementation of design tasks, have specialized knowledge, hold the highest responsibility for contents and quality of architecture designs and control other aspects to cooperate and agree with architecture aspect;

b) Be owner of architecture solutions or directly organize implementation of the owners’ concepts.

5. Architecture designers whose name is specified in design dossiers must:

a) Be capable of taking charge designing construction architecture or taking charge appraising architecture design and be responsible for architecture design;

b) Take charge and be ready to act as design managers if authorized by design managers.

Article 4. Preliminary architecture design dossier

1. Drawings shall cover:

a) Illustrations of layout and location of construction site, figures on project scale, characteristics, current conditions, plot boundary, planning information, direction and route of technical infrastructural constructions that are active and according to approved planning (if any), active structures, surrounding scenery and analysis of traffic connection;

b) Design drawings showing architectural concept must display: functional diagrams, blocks, lines, color and lights on general drawings, perspectives, plan view, elevation view, cross-section, interior, exterior and connection to general architectural space and scenery in the area.

2. Explanation consists of:

a) Explanation for contents specified under Clause 1 of this Article;

b) Orientations regarding solutions for structure, equipment, technical infrastructure and operational management;

c) List of applied regulations and standards;

d) Annexes of legislative documents related to legitimacy of preparation of preliminary architecture design dossiers.

Article 5. Basic architecture design dossier

1. Drawings shall cover:

a) All drawings specified under Clause 1 Article 4 of this Circular;

b) Drawings of architecture solution combining with structure solutions, equipment solutions and technical infrastructure solutions.

2. Explanation consists of:

a) Short introduction of construction site, project scale and characteristics; explanation for architecture concept, architecture design solutions and used materials;

b) Overall design solution of construction premises, location and scale of work items and technical infrastructure in the areas;

c) List of applied regulations and standards;

d) Annexes of legislative documents related to legitimacy of preparation of basic architecture design dossiers.

Article 6. Technical architecture design dossier

1. Contents of technical architecture design dossiers must conform to basic design appraised and approved by competent authorities and clarify technical specifications, materials, dimensions and specific technical calculations for manufacturing, construction and installation.

2. Drawings shall cover:

a) Illustrations of layout and location of construction sites, map of current conditions and plot boundary, and planning information according to approved planning;

b) Overall drawings of the premises: display project items invested for construction, specify which items are constructed anew, renovated or repaired based on current plot conditions, identify red boundary line and construction boundary line, determine entries, exits, traffic routes, technical criteria regarding area of studied plot, construction area, construction density, total floor area, land use coefficients, area of items, number of storeys, internal traffic system, identify boundary and navigate underground structures;

c) Drawings for navigating structures, plan view of storeys, elevation view, cross section, space diagrams and organization;

d) Illustration: general perspectives, corner perspectives, basic interiors and exteriors;

dd) Drawings of dimensions and number of types of doors and stairwells; list of architectural area, materials and color of elevation view, sanitary areas, flooring and list of finishing materials;

e) Drawings of auxiliary works and outside buildings, fences, trees and gardens.

3. Explanation consists of:

a) Clarification of calculations for selection of technical measures, technology line, material properties, clarification of specifications that cannot be displayed in drawings and adequate basis for preparation of total structure cost estimates and construction designs;

b) All details specified under Clause 2 Article 5 of this Circular.

Article 7. Construction architecture design dossier

1. Contents of construction architecture design dossiers must conform to basic design and technical design appraised and approved by competent authorities, display all components of constructions and structures with all dimensions, materials and technical specifications and specify instructions in the drawings for desired implementation.

2. Drawings shall cover:

a) All drawings specified under Clause 2 Article 6 of this Circular;

b) Components of structures of constructions;

c) Details of auxiliary works, garages, fence gates, gardens, flower beds, underground water tanks, drainage channels, scenery lighting, and paving materials of pavements and walkways;

d) Ceiling design, lighting, soundproofing and equipment attached to constructions.

3. Explanation consists of:

a) Adequate explanation of contents that cannot be displayed on the drawings to enable construction teams to follow the design correctly and technical instructions to guarantee implementation of construction design after basic design;

b) All details specified under Clause 3 Article 6 of this Circular.

Article 8. Interior design dossiers

1. Interior design dossiers not included in construction architecture design dossiers specified under Article 7 of this Circular shall be prepared at request of project developers for design contractors.

2. Drawings shall cover:

a) Drawings of current conditions, plan view of interior design and spaces, diagrams analyzing relationships with other functional spaces;

b) Plan views, elevation view, paving, placement of interiors and electrical equipment;

c) Details of interiors and equipment;

d) Perspective drawings.

3. Explanation consists of: list of equipment, materials, instructions for construction contractors to follow the designs and technical procedures for maintenance and preservation.

Article 9. Exterior and scenery design dossiers

1. Exterior and scenery design dossiers shall be prepared independently, not included in construction design dossier and prepared at request of project developers for design contractors.

2. Drawings shall cover:

a) Current conditions of scenery, plan view, elevation view, exterior placement and garden;

b) Architectural details, types of trees, planting beds, miniature scenery, exteriors, walkways, ponds and materials related to the design;

c) Direction for completion of external decoration, garden, list and technical specifications of installed equipment;

d) Overall perspective drawings of garden, details, highlights and miniature scenery.

3. Explanation consists of: list of equipment, materials, plants, equipment, instructions for construction contractors to follow the designs and technical procedures for maintenance and preservation.

Chapter III

SAMPLE OF ARCHITECTURE PRACTICE CERTIFICATE

Article 10. Contents of architecture practice certificate

1. Managing practice certificate number: practice certificate number shall consist of 2 groups of symbols linked with each other by a dash (-), to be specific:

The first group: consists of 3 symbols displaying where the certificate is issued according to Annex I of this Circular;

The second group: consists of code of the certificate.

2. Primary details of an architecture practice certificate are: Basic personal information: 4x6 cm photos, full name, date of birth, ID (citizen ID or passport) number;

Name of issuing body, signature and stamp;

Field of practice and duration of practice for each field that the applicant is applying for issuance of certificate.

3. Practice certificate shall have specifications and primary contents as shown in sample under Annex II attached to this Circular.

Chapter IV

IMPLEMENTATION

Article 11. Transition clauses

Architecture design dossiers of investment construction projects entered into contracts for construction design prior to the effective date hereof shall comply with the signed contracts.

Article 12. Entry into force

This Circular comes into force from September 15, 2020.
